1. Acceptance of Terms
By accessing and using AxionBuild (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to abide by the above, please do not use this service.
Your use of the Service constitutes acceptance of these terms. If you do not accept these terms, you may not use the Service.
Age Requirement
You must be at least 18 years old to use this Service.
2. Description of Service
AxionBuild is a cloud based construction project management application designed to help companies manage projects, track expenses, coordinate teams, and maintain project documentation. The Service provides tools for project management, file storage, team collaboration, scheduling, and financial tracking.
3. Subscription & Pricing
3.1 Subscription Plans
AxionBuild subscriptions may be offered through different purchase channels, including the Apple App Store and direct website billing.
Channel specific terms are listed below and should be reviewed before purchase.
3.2 Free Trial Period
Free trials or promotional offers, if available, are presented at checkout for the applicable purchase channel.
Trial availability, duration, and eligibility may vary by region, platform, and account status.
3.3 Billing
Subscriptions are billed monthly on your subscription anniversary date
Payment will be charged to the credit card or payment method provided during registration
All fees are exclusive of applicable taxes, which will be added if required by law
Invoices will be provided via email
3.4 Payment Methods
We accept major credit cards and other payment methods as indicated during checkout. By providing payment information, you authorize us to charge your account for all fees and charges incurred.
3.5 Failed Payments
If a payment fails, we will attempt to process it again. If payment continues to fail, we reserve the right to suspend your account access until payment is received.
Website Direct Billing
Website direct billing terms, pricing, and any promotional offers apply only to purchases made on our website and do not apply to subscriptions purchased through the Apple App Store.
3.6 App Store Subscriptions
If you subscribe through the Apple App Store, the following terms apply:
Available subscription plans include Pro 3, Pro 8, Pro 13, and Pro 18 monthly plans.
Subscription length: 1 month (auto-renewing).
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
You can manage or cancel your subscription at any time in your Apple ID account settings.
If a free trial is offered, any unused portion of the free trial period will be forfeited when a subscription is purchased.
Subscription pricing is displayed in the App Store at the time of purchase and may vary by region.
4. Cancellation Policy
4.1 How to Cancel
You may cancel your subscription at any time by contacting us through your account settings or by emailing our support team.
If you subscribed through the Apple App Store, you must manage or cancel your subscription through your Apple ID account settings.
4.2 Cancellation Timing
Cancellations take effect at the end of your current billing month
You will retain access to the Service through the end of the current billing period
After cancellation, you will not be charged for future months
Your data will be retained according to our Data Retention Policy
4.3 No Refunds
Except where required by law, no refunds or credits are provided for partial billing periods or unused portions of a subscription.
For Apple App Store purchases, billing and refund requests are handled by Apple under App Store policies.
If a trial or promotional period is offered for your purchase channel, you are responsible for canceling before renewal if you do not wish to be charged.
5. User Responsibilities
5.1 Account Management
You are responsible for maintaining the confidentiality of your login credentials
You must provide accurate and complete information during registration
You agree to keep your password secure and not share it with others
You are responsible for all activities that occur under your account
You agree to notify us immediately of any unauthorized access to your account
5.2 Acceptable Use
You agree NOT to use AxionBuild for
Illegal activities or violation of any laws or regulations
Harassment, threats, or abuse of other users
Transmitting malware, viruses, or any code of destructive nature
Unauthorized access to or use of our systems
Reverse engineering or attempting to discover our source code
Copying or reproducing the Service without authorization
Violating intellectual property rights
Transmitting spam or unsolicited communications
5.3 Content Responsibility
You are responsible for
All content you upload, create, or transmit through the Service
Ensuring you have the legal right to share all content
Ensuring content does not infringe on third party rights
Complying with all applicable laws regarding your content
6. Construction Specific Disclaimer
6.1 Professional Advice
AxionBuild does NOT provide professional legal, safety, or engineering advice. The Service is a management tool only. AxionBuild:
Does not replace professional consultation with architects, engineers, or contractors
Does not ensure compliance with local building codes or regulations
Does not provide safety recommendations or protocols
Does not constitute professional services in any jurisdiction
6.2 User Responsibility for Compliance
You acknowledge that you are responsible for
Complying with all federal, state, and local construction laws and regulations
Obtaining all necessary permits and licenses
Ensuring OSHA safety compliance and worker safety standards
Following local building codes and zoning requirements
Maintaining proper insurance coverage
Hiring qualified and licensed professionals
Conducting proper inspections and quality assurance
6.3 Liability Limitation
AxionBuild is NOT liable for
Project failures, delays, or cost overruns
Safety incidents or workplace injuries
Non compliance with building codes or regulations
Decisions made based on information in the Service
Quality of work performed by contractors or team members
Any legal or regulatory violations by users
Structural failures, property damage, or personal injury
You assume all risks associated with your construction projects and use of professionals.
7. Data Security & Privacy

Keep your login credentials confidential
Log out when finished using the Service
Report suspicious activity immediately
Not store extremely sensitive data (SSNs, bank account numbers) in clear text
Maintain your own backups of critical data
Comply with your organization's data security policies

You are granted a limited, non exclusive license to use the Service for legitimate business purposes
8.2 Your Content
You retain ownership of content you create or upload
You grant AxionBuild a license to use your content to provide, maintain, and improve the Service
You grant AxionBuild permission to back up and store your content for security purposes
You agree that AxionBuild may use aggregated, anonymized data for analytics and service improvement
9. Warranty Disclaimer
9.1 "As Is" Service
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AXIONBUILD MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING:
Warranty of merchantability
Warranty of fitness for a particular purpose
Warranty that the Service will be error free
Warranty that the Service will be uninterrupted
Warranty that the Service will meet your specific needs
9.2 No Guarantee of Results
AxionBuild does not guarantee
Project success or completion
Accurate calculations or projections
Availability of the Service (we aim for 99% uptime but do not guarantee it)
Compatibility with third party software
Data recovery after deletion
10. Limitation of Liability
10.1 Maximum Liability
IN NO EVENT SHALL AXIONBUILD BE LIABLE FOR MORE THAN THE TOTAL AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE INCIDENT.
10.2 Excluded Damages
AXIONBUILD SHALL NOT BE LIABLE FOR
Lost profits or revenue
Lost or corrupted data
Loss of business opportunities
Loss of goodwill or reputation
Indirect, incidental, or consequential damages
Punitive or exemplary damages
Any damages arising from your use or misuse of the Service
11. Service Availability & Maintenance
11.1 Uptime Goals
We aim to maintain 99% service availability. However, we do not guarantee uninterrupted service.
11.2 Maintenance & Downtime
We may perform scheduled maintenance with or without notice
Emergency maintenance may require immediate service interruption
We are not liable for losses resulting from scheduled or emergency maintenance
We will attempt to provide advance notice of scheduled maintenance when possible
11.3 Service Suspension
AxionBuild reserves the right to suspend or terminate your account if:
You violate these Terms of Service
You engage in illegal activities
Your account is used for hacking or unauthorized access
Your account is dormant for extended periods
Payment is not received
12. Changes to Terms
AxionBuild reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service following any changes constitutes acceptance of the new terms.
We will attempt to notify you of material changes via email, but it is your responsibility to review these terms regularly.
13. Dispute Resolution
13.1 Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction where AxionBuild operates, without regard to its conflict of law provisions.
13.2 Arbitration
You agree that any dispute arising from or relating to these Terms of Service or your use of AxionBuild shall be resolved through binding arbitration, rather than in court. Each party waives the right to a jury trial.
